Your Right to Bail:
The law allows everyone the right to bail. Possible exceptions would be if the defendant is a fugitive from justice or a parole violator, or if the accused is charged with an offense punishable by the death penalty or life in prison. A Bond cannot be issued where warrants are for non-payment of child support or conditions of probation.

Bail Bonds:
An alternative to posting your own bail is a Bail Bond or Surety Bond. Bail guarantees to the Court the defendant's appearances at all his scheduled court events. The process starts as a contractual undertaking by an admitted insurance company guaranteeing the face value of the bond. The Bail Agents guarantee is made through the insurance company that they will pay the bond forfeiture if the defendant fails to appear for any of their scheduled court events.

Before we can post a bail bond, we need a family member(s) or a friend(s) to assure us that the defendant will appear at all his court dates. This is done through an Indemnity Agreement securing the bail bond transaction. This is because the bond we issue guarantees the court that the defendant will appear whenever ordered, up until sentencing or final disposition of the case.

A quick interview will help us determine whether the signature and promise of the guarantor or co-signer will be sufficient to secure the bond. Obviously, for a large bail or a criminal charge with severe consequence, the indemnitor(s) will need to secure the bond with property or other collateral.

Warrants:
If you are aware or have advanced knowledge of a pending charge or warrant, we can arrange the posting of a bond. This would avoid the stress, embarrassment and inconvenience of an arrest.

Frequently Asked Questions

Chances Bail Bonds proudly provides bail bonding services in regions throughout the Commonwealth of Virginia. If you or someone you know requires fast and affordable bail bonding services, we invite you to contact us for a free consultation, during which we will explain how bail works, how a bail bonding agency can help you afford bail, and what you’ll need to do to get started with the bail bonding process.

We encourage you to contact us for more information about the bail bonding process. To get started learning more, here are some answers to a few frequently asked questions that may help you to get a better understanding of how the bail bonding process works:

What is bail?

Bail is a financial exchange in which the courts will agree to allow a suspect to await his or her trail outside of jail in exchange for money. That money is called bail. The amount of the bail is based on the suspected crime, locality in which the crime was committed, and other variables, such as a suspect’s prior convictions.

In order to be freed from custody on bail while awaiting trial, the suspect must provide the courts with the full amount of the bail, which the courts will hold onto until the suspect completes his or her legal obligation.

Heads up! Many of our clients have heard that there are cases where the courts will issue refunds once the legal obligation is complete. It is important to note that clients will not receive a refund of the bail amount or their premiums made to us. Here’s how the refund works: Once the legal obligation has been completed, the bail money will be returned to the suspect only if the suspect pays the full bail amount on his or her own. Remember: If a bail bonding agency, such as Chances Bail Bonds, provides the bail to the courts, the bail will be returned to the agency and not to the client. Clients will not receive a refund of their down payment to Chances
Bail Bonds under any circumstances.

However, clients may get a refund in the event that they post cash collateral and complete their legal obligation. Contact us for more information or details about your unique situation.

What happens if I can’t pay bail?

Because of the high cost of bail, many suspects cannot afford to pay the full amount on their own. In such a situation, those individuals can enlist the services of a bail bonding agency, such as ours, to help cover the cost of bail. Our bail bonding agents will provide the full amount of the bail to the courts on behalf of the client in exchange for a non-refundable fee for services.

How expensive are bail bonding services?

Each bail bonding agency can determine its own rates for bail bonding services. Chances Bail Bonds charges the lowest possible bail bonding rates allowed by law so that bail bonds are more accessible to all of our clients.

We also offer free consultations 24 hours a day, 7 days a week so that our clients can get the help they need – when they need it – regardless of their financial situations.

When does someone have to pay bail?

Bail is always an optional opportunity for suspects charged with committing a crime. Therefore, no suspect is required to pay bail. However, if a suspect chooses not to pay bail when given the opportunity, the suspect will stay in jail while awaiting his or her trial. This waiting period can sometimes be several months or more.

Here’s what happens that may lead to a bail option: When a suspect is arrested, the individual will be taken into custody and charged with a crime for which he or she is suspected of having committed. In the U.S., all suspects are innocent until proven guilty by a court of law. Therefore, all suspects will have a trial before sentencing. In many cases, the individual will be given the opportunity to get out of custody while awaiting his or her trial by paying bail.

Can prisoners get out of prison on bail?

Individuals in the prison system are not given the opportunity to get out of prison on bail. It is important to understand the difference between jail and prison. Individuals go to prison once they have been sentenced for a crime. However, while awaiting sentencing, individuals are held in jails - or given the opportunity to get out of jail on bail or on their own recognizance. Bail is available only to suspects awaiting trial; not to convicted criminals.

Who can get a bail bond in Virginia?

Any suspect charged with a crime can get a bail bond if the courts have given them the option of getting out of jail on bail while they await their trials. Not every suspect will be given the opportunity to get out of jail on bail.

Also, some suspects are able to get out of jail on their own recognizance, which means that they are not required to pay bail. Contact us for more information about the different opportunities or to discuss options available to you. We make it easy for all of our clients to afford to pay for bail bonding services by charging the lowest allowable rates for our services and by offering free consultations to each of our clients.
